Terms of Service

This document is a working draft provided for the Locbrant beta and is not legal advice. It must be reviewed by a qualified lawyer before public launch.
Welcome to Locbrant. Locbrant is a discovery platform that helps people in Hong Kong find local small shops, independent makers, and the products they sell, then contact those shops directly. These Terms of Service (the “Terms”) govern your use of the Locbrant website and services (the “Platform”).
By using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.
1. What Locbrant is — and is not
Locbrant is a discovery and listing platform only. We surface shops and products so buyers can find them, and we route buyers to a shop’s own contact channels (such as WhatsApp, Instagram, or a website).
Locbrant is not a marketplace and is not the seller of any product. We are not a party to any transaction between a buyer and a shop, and we do not act as agent, broker, importer, or seller-of-record for any listed product.
2. No payments, orders, or buyer protection on the Platform
The Platform does not provide checkout, a shopping cart, payment processing, order management, escrow, or any buyer-protection or guarantee scheme. All ordering, payment, delivery, pickup, exchange, and refund arrangements happen directly between the buyer and the shop, off the Platform.
We do not guarantee that any product is available, accurately described, or fairly priced, or that any contact, order, or transaction will be completed. Any dealing you have with a shop is solely between you and that shop.
3. Buyers
As a buyer, you are responsible for your own decisions when contacting and dealing with a shop, including verifying product details, price, availability, and delivery or payment arrangements before you pay or commit to anything.
- Contact shops respectfully and lawfully.
- Do not use shop contact details for spam, harassment, or any unlawful purpose.
- Carry out your own checks before paying a shop or sharing personal or payment information with it.
4. Shops and sellers
If you operate a shop on Locbrant, you are solely responsible for everything you publish and for your dealings with buyers, including:
- Accurate product information, pricing, stock status, and contact details.
- The legality, safety, authenticity, and quality of the products you list, and any claims you make about them.
- All ordering, payment, delivery, pickup, exchange, and refund arrangements with buyers.
- Holding any licence, registration, or permission required to sell your products in Hong Kong.
- Complying with applicable consumer-protection, trade-description, and other laws.
- Confirming that you have the right to publish the content, images, and trademarks you upload, and that they do not infringe anyone else’s rights.
5. Shop approval and moderation
Shops are reviewed before they appear publicly. This review is a basic onboarding and quality check — it is not an endorsement, certification, or guarantee of any shop, seller, or product.
Locbrant approves shops, not individual products. Products are not pre-approved one by one. Once a shop is approved, the products it marks public become visible automatically.
We may, at our discretion and without notice, decline, pause, hide, change the presentation of, or remove any shop, product, listing, report, or other content — for example if it appears to break these Terms, the law, or our content rules, or to protect buyers and the integrity of the Platform.
6. Restricted and prohibited items
You may not list, promote, or use the Platform to direct buyers to items that are illegal in Hong Kong or otherwise prohibited by us, including:
- Counterfeit, replica, or trademark-infringing goods.
- Weapons, controlled drugs, and regulated or hazardous goods sold without the required licence.
- Recalled, unsafe, or stolen goods.
- Live animals, and any product whose sale would breach Hong Kong law.
- Anything that is fraudulent, deceptive, or infringes the rights of others.
7. Accounts and security
Some features require an account. You are responsible for the information you provide, for keeping your password confidential, and for activity that happens under your account. Tell us promptly if you believe your account has been used without your permission.
You must be old enough under Hong Kong law to enter into these Terms. The Platform is not intended for children.
8. Accounts and saved items
A Locbrant account lets you save products or shops to a personal list. A saved item is only a bookmark — it does not reserve stock and does not guarantee that the product or shop will remain available, priced as shown, or listed at all.
Holding a Locbrant account does not create any transaction, agency, or other relationship with Locbrant; buyers still contact and deal with shops directly. The same account can be used to browse and save as a buyer and, separately, to open and manage a shop.
9. Reviews
Locbrant does not currently offer a public review or rating feature. We may maintain internal review infrastructure in preparation for a future feature, but no public reviews are submitted, displayed, or available on the Platform until it is launched. If and when a public review feature launches, it will be governed by these Terms and the separate review rules and moderation terms we publish at that time.
10. Reports, analytics, and how the Platform works
Buyers and sellers can report listings or shops they believe break these Terms or the law. Reports are private and help us moderate the Platform; submitting a report does not guarantee any particular outcome.
We collect limited activity data — such as product views, shop views, and contact-button clicks — to operate the Platform, prevent abuse, and give shops a basic sense of how buyers find them. How we handle personal data is described in our Privacy Policy.
11. Intellectual property
The Locbrant name, logo, design, and software are owned by the platform operator and may not be copied or used without permission. Shop and product content remains the responsibility of the shop that posts it; by posting it, a shop grants Locbrant a non-exclusive licence to host, display, resize, and promote that content for the purpose of operating and marketing the Platform.
If you believe content on the Platform infringes your rights, please contact us so we can review it.
12. Disclaimers and limitation of liability
The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Locbrant disclaims all warranties about the Platform and about any shop, seller, or product listed on it.
To the fullest extent permitted by law, Locbrant is not liable for any loss or damage arising from your use of the Platform, from any dealing between a buyer and a shop, or from any product purchased or contacted through the Platform. Nothing in these Terms excludes any liability that cannot be excluded under Hong Kong law.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “last updated” date above, and significant changes may be highlighted on the Platform. Continuing to use the Platform after a change means you accept the updated Terms.
14. Contact
Questions about these Terms can be sent to the platform operator through the contact channel published on the Platform. A formal business name and contact address will be added before public launch.
